Hourly- A set rate charged per hour for all work done on behalf of client
Flat Rate- A flat rate set at the beginning of the case, or per IEP/IPP, etc.
Due Process attorneys' fees paid by district- If Amster Law Firm is successful at due process (either through settlement or hearing), the IDEA provides that the district will pay attorneys' fees. In any action or proceeding regarding the due process hearing, the court, in its discretion, may award reasonable attorneys’ fees as part of the costs to you as parent of a child with a disability if you are the prevailing party in the hearing. Reasonable attorneys’ fees may also be made following the conclusion of the administrative hearing, with the agreement of the parties. (20 USC 1415[i][B]–[G]; 34 CFR 300.517; EC 56507[b])
