Amster Law Firm Provides Flexiable Retainer Agreements

Hourly

A set rate charged per hour for all work done on behalf of the client.

Flat Rate

A flat rate set at the beginning of the case, year, or per IEP, IPP, Self Determination Program Independent Faciliator.

Due Process Attorneys’ Fees Paid by the District

If Amster Law Firm is successful at due process (either through settlement or hearing), the IDEA provides that the district will pay attorneys’ fees. In any action or proceeding regarding the due process hearing, the court, in its discretion, may award reasonable attorneys’ fees as part of the costs to you as parent of a child with a disability if you are the prevailing party in the hearing. Reasonable attorneys’ fees may also be made following the conclusion of the administrative hearing, with the agreement of the parties. (20 USC 1415[i][3][B]–[G]; 34 CFR 300.517; EC 56507[b])

Amster Law Firm generally does request attorney’s fees from the client when representing a student in due process.

Self Determination

Note: As of August 22, 2022, Amster Law Firm will only be receiving funds from the regional center for the drafting of the Person Centered Plan. All services beyond that will be billed to the client at an hourly or flat rate. 

  

IHSS Hearings

Amster Law Firm provides different pricing for attorney’s fees for IHSS Hearings. The most popular one is a flat rate of attorney’s fees only if we are successful, or a contingency rate. 


Amster Law Firm has successfully represented clients who are not able to pay for attorney’s fees in due process and IHSS matters. Please don’t lack of funds to pay for an attorney hold back what your child is rightfully entitled to. Please contact us to discuss these different options.
